Car sharing legislation
- In some jurisdictions, peer-to-peer car sharing legislation — which generally centers around insurance, safety, and taxes — may apply to Resortifi peer-to-peer trips and hosts in those states.
- If you’re located in a jurisdiction that has car sharing laws, consult your legal advisor for an understanding of whether these laws apply to you, offer protections to you, or require certain actions by you.
- Resortifi will void your Resortifi protection plan, and you’ll receive no coverage if it’s discovered that you engaged in intentional or fraudulent material misrepresentation or fraud or collusion with guest(s).
We’ve highlighted below, strictly for informational purposes, aspects of and/or links to the laws for Alaska, Arizona, California, Colorado, Connecticut, Delaware, Florida, Georgia, Hawaii, Illinois, Indiana, Kansas, Kentucky, Louisiana, Maine, Maryland, Nevada, New York, Ohio, Oklahoma, Oregon, Tennessee, Texas, Virginia, Washington, and West Virginia.
Alaska car sharing regulations
- If your vehicle is registered in the state of Alaska and located in Anchorage, a city ordinance purports to require Resortifi to collect from guests an 8% vehicle sharing tax on the gross transaction amount for trips for which a Resortifi host qualifies as a “retail business”
- Resortifi will collect and remit this tax on behalf of hosts who are “required to hold a business license in Alaska and/or report business income or losses to the IRS” for peer-to-peer car sharing
- You must inform Resortifi as to whether you currently hold a business license in Alaska or report business income or losses to the IRS for peer-to-peer car sharing so we can collect the appropriate rate where necessary
- If you fail to certify your business status, you may be unable to host on Resortifi
Arizona car sharing regulations
- If your vehicle is registered in the state of Arizona, you must abide by Arizona’s Peer-to-Peer Car Sharing statute
- Arizona requires hosts to collect a car sharing tax from guests whose trip begins in Arizona. Resortifi collects and remits this car sharing tax on hosts’ behalf
- The tax rate depends on whether you paid applicable sales and use taxes on the purchase of the vehicle you list on Resortifi; We'll ask you to confirm whether you paid applicable taxes on your vehicle during the listing process for new vehicles or via email for listed vehicles on the platform before this requirement was put in place.
California car sharing regulations
- If your vehicle is registered in the state of California, you must abide by California’s Assembly Bill 1841 and the state’s personal vehicle sharing bill
- Your insurance company can’t cancel or decline to renew your policy because you take part in car sharing
- Share your insurance policy information in accordance with California peer-to-peer car sharing statutes.
Colorado car sharing regulations
- If your vehicle is registered in the state of Colorado, you must abide by Colorado’s Peer-to-Peer Motor Vehicle Sharing program act
Connecticut car sharing regulations
- If your vehicle is registered in the state of Connecticut, you must abide by Connecticut’s Peer-to-Peer Car Sharing program act
Delaware car sharing regulations
- If your vehicle is registered in the state of Delaware, you must abide by Delaware's Peer-to-Peer Car Sharing program act
Florida car sharing regulations
- If your vehicle is registered in the state of Florida, you must abide by Florida’s Peer-to-Peer Car Sharing Program act
- Florida requires Resortifi to collect the applicable sales tax and a per day surcharge from guests whose trip begins in Florida
Georgia car sharing regulations
- If your vehicle is registered in the state of Georgia, you must abide by Georgia’s Peer-to-Peer Car Sharing Statute
Hawaii car sharing regulations
- If your vehicle is registered in the state of Hawaii, you must abide by Hawaii’s Peer-to-Peer Car-Sharing bill
Illinois car sharing regulations
- If your vehicle is registered in the state of Illinois, you must abide by Illinois’s Car Sharing Program act
Indiana car sharing regulations
- If your vehicle is registered in the state of Indiana, you must abide by Indiana’s Peer-to-Peer Vehicle Sharing Statute
- Indiana requires Resortifi to collect a car sharing tax from guests whose trip begins or ends in Indiana
- The tax applies to the full trip cost, except deposits, protection plan, and delivery
Kansas car sharing regulations
- If your vehicle is registered in the state of Kansas, you must abide by Kansas’s Peer-to-Peer Vehicle Sharing Program Act.
Kentucky car sharing regulations
- If your vehicle is registered in the state of Kentucky, you must abide by Kentucky’s Peer- to-Peer Car Sharing Program statute.
Louisiana car sharing regulations
- If your vehicle is registered in the state of Louisiana, you must abide by Louisiana’s House Bill No. 532.
Maine car sharing regulations
- If your vehicle is registered in the state of Maine, you must abide by Maine’s Peer-to-Peer Car Sharing Program Model Act.
Maryland car sharing regulations
- If your vehicle is registered in the state of Maryland, you must abide by Maryland’s peer-to-peer car sharing law.
- You’re prohibited from sharing a vehicle on Resortifi that is more than 10 years old.
- You’re exempt from this rule if you’ve obtained a valid state inspection certificate within 90 days before listing your vehicle.
- You must get a valid state inspection certificate at least once for every 10,000 miles added to your odometer since your prior state inspection certificate was issued.
- Maryland requires Resortifi to collect a car sharing tax from guests whose trip begins or ends in Maryland.
- The tax applies to the full trip cost, except deposits, protection plan, and delivery.
Nevada car sharing regulations
- If your vehicle is registered in the state of Nevada, you must abide by Nevada’s Peer-to-Peer Car Sharing Program Act.
- Nevada requires hosts to collect a car sharing tax from guests whose trip begins in Nevada. Resortifi collects and remits this vehicle sharing tax on hosts’ behalf.
- The tax rate depends on whether you paid applicable sales and use taxes on the purchase of the vehicle you list on Resortifi. We will collect a certification regarding this information either at listing or through a separate certification process facilitated outside of the listing process.
- If you live in Nevada, deliver cars to or within Clark County, and operate your business on Resortifi as a corporation, limited partnership, or limited-liability company (LLC), you’ll need a Peer-to-Peer Shared Vehicle Owner license (NAICS 485995)
- Hosts who operate as individuals and/or hosts who live outside of Nevada but deliver to Clark County don’t need to get a license
New York car sharing regulations
- If your vehicle is registered in the state of New York, you must abide by New York’s Peer-to-Peer Car Sharing law.
- The tax is only applied if you are an individual host and are using Resortifi-provided insurance for your listings.
- New York requires Resortifi to collect a car sharing tax from guests whose trip begins and ends in New York. The applicable tax rate depends on where you pick up the car.
Ohio car sharing regulations
- If your vehicle is registered in the state of Ohio, you must abide by Ohio’s Peer-to-Peer Carshing Program regulation.
Oklahoma car sharing regulations
- If your vehicle is registered in the state of Oklahoma, you must abide by Oklahoma’s Peer-to-Peer Car Sharing Program Act
Oregon car sharing regulations
- If your vehicle is registered in the state of Oregon, you must abide by Oregon Personal Vehicle Sharing regulation (Section 742.585)
- Your insurance company can’t cancel or decline to renew your policy because you take part in car sharing
- Share your insurance policy information in accordance with Oregon peer-to-peer car sharing statutes.
Pennsylvania car sharing regulations
- If your vehicle is registered in the state of Pennsylvania, you must abide by the provisions in Pennsylvania’s act providing for Peer-to-Peer Car Sharing and the state's related tax legislation
Rhode Island car sharing regulations
- If your vehicle is registered in the state of Rhode Island, you must abide by the Rhode Island Act Relating To Insurance -- Peer-To-Peer Car Sharing Program (effective April 1, 2023)
Tennessee car sharing regulations
- If your vehicle is registered in the state of Tennessee, you must abide by Tennessee’s General Assembly House Bill 1593 (SB 2207).
Texas car sharing regulations
- If your vehicle is registered in the state of Texas, you must abide by Texas’s Peer-to-Peer Car Sharing Programs Act.
Virginia car sharing regulations
- If your vehicle is registered in the state of Virginia, you must abide by Virginia Senate Bill 735
- Virginia requires hosts to collect a car sharing tax from guests whose trip begins or ends in Virginia. Resortifi collects and remits this vehicle sharing tax on hosts’ behalf.
- The tax rate depends on the number of Virginia-licensed vehicles you share on any vehicle sharing platform with delivery or pickup in Virginia
- For hosts sharing up to 10 vehicles, the tax rate is 7% of the gross transaction amount
- For hosts sharing more than 10 vehicles, the rate is 10%, or the same as rental vehicles.
- Resortifi applies the appropriate tax based on the number of vehicles listed by you on Resortifi. There is nothing additional for you to do.
Washington car sharing regulations
- If your vehicle is registered in the state of Washington, you must abide by the Peer-to-Peer Vehicle Sharing Program Act
- Your insurance company can’t cancel or decline to renew your policy because you take part in car sharing
West Virginia car sharing regulations
- If your vehicle is registered in the state of West Virginia, you must abide by West Virginia Legislature House Bill 4474
- West Virginia requires Resortifi to collect a car sharing tax from guests whose trip begins or ends in West Virginia
- The tax applies to the full trip cost, except deposits, protection plan, fuel replacement, tolls and tickets
